In addition to hosting the 2016 Michael Thorsnes International Arbitration Competition, the VICAM team also offers a Minimum Continuing Legal Education (MCLE) course on the same weekend.
The USD Law School and the VICAM Program is please to announce that this year's MCLE will feature Professor Robert F. Muth (Supervising Faculty Member for the USD Veteran’s Clinic) and Ms. Barbara Reeves, Esq. (full-time neutral with Judicial Arbitration and Mediation Services or "JAMS") to discuss several complex issues confronting the modern practice of arbitration.

Costs: The MCLE will be free for all university students participating USD Michael Thorsnes International Arbitration Competition, as well as other interested USD Law students. For other attendees, the cost is $30.00, payable by cash or check at the event, with a $10.00 discount provided for those attendees who volunteer to judge the Michael Thorsnes Pre-Moot. Schedule: To receive credit for the MCLE, please check in by 5:20 p.m., so that we can give you the required paperwork. Otherwise, the MCLE will start promptly at 5:30 p.m. Following the MCLE there will be a mixer for all attendees, from 7:30 - 9:00 pm. |

The MCLE will be held on Friday, January 29, 2016 in the Grace Court Room from 5:30 to 7:30 p.m. with drinks and appetizers to follow. Our two distinguished speakers will discuss the following topics:
- Professor Muth will present on the challenges of certifying a class in arbitration, drawing from his recent experiences in Cordova v. United Education Institute, in which Professor Muth and his co-counsel successfully certified a class before AAA Arbitrator Louise A. LaMothe. Ms. LaMothe's order was later upheld by Judge Ronald S. Prager, Superior Court of California, County of San Diego.
- Ms. Reeves will discuss the practice of discovery, particularly e-discovery, in the arbitral setting. Her presentation will cover:
- Understanding the Electronic Discovery Reference Model
- Differences between e-discovery in litigation and in arbitration
- Ethics and Competence Requirements
- Types of data and their significance
- Outsourcing-discovery or keeping it in-house
- Predictive coding
- Sanctions
- Preservation
- E-discovery cost recovery
- International e-discovery development
